On The Judgement In Ruchi Majoo Vs. Sanjeev Majoo

ISSUE: 

The issue in this case is whether the wife, Ruchi Majoo, is entitled to maintenance from her husband, Sanjeev Majoo.

RULE:

Wives who are unable to support themselves may receive maintenance payments under Section 125 of the Code of Criminal Procedure in India. This clause aims to protect women from financial hardship and to enable them to maintain themselves.

APPLICATION:

As Ruchi Majoo was unable to support herself, she filed a petition in this case asking her husband, Sanjeev Majoo, for maintenance. The husband filed an appeal after the trial court awarded her maintenance. Ruchi Majoo, being a qualified dentist who could support herself, was deemed not entitled to maintenance, according to the High Court, which overturned the trial court’s ruling.

But the Supreme Court disapproved of the High Court’s justification. The Court ruled that Ruchi Majoo’s qualification as a dentist did not immediately void her maintenance rights. The Court pointed out that the goal of Section 125 is to guarantee that women, irrespective of their capacity for earning a living, are not left penniless. The husband’s earnings and financial situation were taken into account by the court when deciding how much maintenance should be granted.

CONCLUSION:

In light of this, the Supreme Court maintained the lower court’s ruling and granted Ruchi Majoo with support. The Court determined that she has qualified for maintenance since her husband could assist her financially and she was unable to sustain herself.
